Luka

Every time I told Luc LeClair something, it would mysteriously wind up in the press—Luka Magnotta

It was a weird trial. With a case like this, how could it not be? It was one of the most bizarre murders in history, why should the trial be different?

There was never any issue of who did it, just why? It would be rather hard for Luka to plead not guilty when he took great pains to provide evidence that he was in fact the killer.

And there is the rub. Someone that had to do something like this had to be ridiculously insane, right? If you saw the video and saw the things that Luka did and don’t think Luka is crazy, well then, you’re probably crazy. Everyone knew Luka killed Jun Lin. He videotaped himself doing it and posted it on the Internet. I mean, it was him, we all knew that.

But in the case of this trial, it wasn’t that easy. For the charge of murder, jurors had four ways they could go; guilty of premeditated first-degree murder; guilty of second-degree murder; guilty of manslaughter; or not criminally responsible, which is otherwise known as NCR. There was zero chance of him being found not guilty, not when he did what he did, especially not the way he did it.

The judge in the case, Guy Cournoyer, explained to jurors the concept of NCR saying “Under our law, the verdict of not criminally responsible by reason of mental disorder is not a loose term, quite the contrary. There are specific criteria to determine whether the defense of mental disorder is applicable.”

Although he denied it to me, Luka has a long history of professionals saying he is schizophrenic. Many think he also has narcissistic and antisocial personality disorders, and it is easy to see why. But whether or not Luka is mentally ill doesn’t have a whole lot to do with the situation when it comes to an NCR defense.

When it comes to Canadian law, suffering from a personality disorder or even schizophrenia isn’t enough for an NCR verdict to come down because in theory it doesn’t mean Luka didn’t understand what he was doing was wrong. What it all boils down to is this. Everyone in the courtroom could think that Luka was the craziest person in the entire world. He could be hearing voices. He could be saying that he was the voice of God; I mean, he could even kill someone, hack his body up, videotape it, and throw the video up on the Internet, (oh wait, he did that) but the only thing that matters is whether or not he understood that killing Jun Lin was not only illegal, but wrong.

And the other thing is, when it comes to Luka, who really knows what he thinks or what moral code he understands? I’ve interviewed him. I’ve talked extensively with his mother. I certainly have my ideas of what he thinks, but do I really know what he thinks?

I don’t.
